anononetwo According to a Cape rep they are considering open-sourcing their app. As for the Palantir connection, that certainly put a knot in my throat, but after watching several interviews with Doyle and paying close attention to how he answered questions and his body language, I'm no longer concerned with this and, actually, his past experience is probably a huge asset in his new venture.
Regarding billing, Stripe has your personal info, but your account with Stripe is tokenized, so Cape doesn't know who you are. That's obviously less than rock-solid to us privacy guys, but at least it's a step in the right direction.
Regarding warrants, it goes without saying that all carriers must hand over data or they'll no longer be a carrier, but again, Cape goes the extra mile in protecting their customers, both from a data collection and retention standpoint, as well as how they handle such requests (granted, we are asked to trust them):
As a mobile carrier, we're required to be responsive to requests from law enforcement, and are fully compliant with CALEA, the federal wiretap law. However, we seek to minimize the amount of data we collect and retain so that we can only turn over what (little data) we have.
That said, we push back on any law enforcement requests that are not backed by legal process, and we do challenge requests that are not narrowly tailored.
In addition, before making any disclosure, Cape will notify its subscribers of receipt of any legal process seeking disclosure related to their accounts, thereby giving you the opportunity to challenge that request. In cases where we are explicitly prohibited by law or court order from notifying a subscriber about a government request, we will challenge any such request that is not narrowly tailored or otherwise lawful.
In the end when you consider all of the privacy, security and many other features that Cape offers, there is no other carrier that comes close. Granted the company is far from what any of us here would consider ideal, but it's just about as good as it gets. FOSS-ing their app would be appreciated and there's probably other things they could do better, such as rotating the IMIE which may be possible since they write their own SIM's (???).
