Kamika242 And this court always decides against the people. Just look who the judges are and how they get their post there. We don't have an independent justice here in the EU.
Arguably, the purpose of a court is not to represent the will of the people, but to from the legal perspective evaluate whether a certain thing that happened is lawful. The court is the institutions that gets involved when other institutions in society has failed, and it very intentionally works in a different way than other institutions, including institutions aimed to representing the will of the people.
With that said, I doubt Chat Control 1.0 will be considered unlawful by a court, since it has been effective law in the EU for a long time already. It was probably if Chat Control 2.0 would had happened that the court may have helped, since that law contradicted several constitutional laws in the EU. I believe the laws Chat Control 1.0 contradicts (or rather gives exemptions too) are at the same level of Chat Control 1.0, so would not override it. But I am not a lawyer, and also haven't looked super closely into this.
